vehicular assault; or fleeing or attempting to elude law enforcement ; using the vehicle to commit a felony, other than a felony described above must not have an alcohol result of .02 to .039 (when driving any vehicle for Publix business) within the previous three years * must not have one prohibited item violation for alcoholic beverages or illegal drugs found in a CMV within the previous three years must not have any of the following within the previous three years two Class II accident;
