Job Description:

Under general direction of the Legal Affairs department, the Marketing/Intellectual Property Senior Attorney is responsible for drafting, negotiating and interpreting contracts, letter agreements and other legal documentation for advertising and marketing services/projects, digital, social media, data acquisition, intellectual property licensing and acquisition, reviewing marketing materials and managing compliance requirements, contractual obligations and dispute resolution. This position will primarily support the Marketing Communications, Marketing Content Distribution and Entertainment teams.

Job Responsibilities:

  • Assist with drafting policies and procedures and development of training surrounding regulatory and statutory compliance obligations and contractual requirements with a focus on advertising and consumer protection issues.
  • Provide general legal support for the advertising, marketing and sales teams, , including but not limited to researching applicable U.S. and international laws and regulations, negotiating, drafting and interpreting agreements, and advising on regulatory and contractual compliance obligations, with experience in advising on matters including but not limited to privacy, data collection and data sharing, consumer protection, intellectual property rights clearance and acquisition (i.e., music, talent, images), rights of publicity, trademark, copyright, user generated content, sweepstakes and promotions.
  • Understands and actively participates in Environmental, Health & Safety responsibilities by following established UO policy, procedures, training and team member involvement activities.
  • Negotiate, draft and interpret complex business contracts across a broad range of advertising, marketing and sales initiatives, including influencer marketing, social media, digital marketing and advertising, contests and promotions, television and film productions, marketing, consulting and creative services agreements and provide support for dispute resolution with contracted parties, termination of contracts and other litigation support as assigned.
  • Performs other duties as assigned.
  • Manages special projects, monitors international and U.S. policies, regulations, legislation laws pertaining to consumer marketing and advertising in travel and tourism industry, digital media, e-commerce, and data privacy.

Job Requirements:

  • Demonstrated ability, in a positive, commercial and practical manner, to identify, prioritize and resolve issues quickly and effectively.
  • Integrity, honesty and trust and the ability to maintain strict confidentiality are also imperative to this role.
  • Strong prioritization and time management skills.
  • Strong understanding of intellectual property law, including trademark and copyright, rights of publicity, rights acquisition, and clearance.
  • The ability to work independently with minimal supervision is required.
  • Strong written and verbal communication and interpersonal skills.
  • Sound business judgment, and flexibility/adaptability to manage multiple wide-ranging matters, conflicting deadlines, and new areas of expertise as business needs change.
  • Must be a self-starter capable of working with various elements within a diverse organization to provide the highest level of service.
  • Proficient understanding of data protection and data privacy legal issues, both domestic and international.
  • Proven capability to lead and drive change in a global environment.
  • Strong understanding of marketing and consumer protection laws, with at least 5 years’ experience in social media and digital marketing, and the legal requirements, both domestic and international.
  • Extensive contract drafting experience in complex services and license agreements.
  • Proven ability and commitment to work both independently and collaboratively with numerous people at all levels throughout the company.

Qualification & Experience:

  • At least 5 years’ post-law school experience, as an attorney, preferably with top-tier law firm or corporate legal department.
  • At least 5 years’ experience advising clients on consumer protection and data privacy, marketing, advertising and rights clearance.
  • At least 5 years’ experience interpreting, negotiating and drafting complex commercial transactions.
  • Experience with social media, digital marketing and intellectual property strongly preferred.
